TOWN OF NORTH HERO, VERMONT NOTICE OF ADOPTION OF TOWN OF NORTH HERO ANIMAL CONTROL ORDINANCE On January 6, 2020, the Selectboard of the Town of North Hero, Vermont adopted the Town of North Hero Animal Control Ordinance pursuant to 24 V.S.A. § 1972. This notice is published pursuant to 24 V.S.A. § 1972 to inform the public of this adoption and of the citizens’ right to petition for a vote to disapprove the adoption. This ordinance replaces the Dog Ordinance adopted by the Selectboard of the Town of North Hero on May 3, 2010. The Town of North Hero Animal Control Ordinance adopted January 6, 2020, includes twelve sections: Purpose, Definitions, Disturbances and Nuisances, Waste Disposal, Collar and License, Humane Care of Dogs and Domestic Animals, Enforcement, Nuisances and Fines, Impoundment, Appeals, Animal Control Officer Duties, and Severability. The ordinance was reformatted to improve readability, adds the definition of “domestic animal”, changed the section title “Pooper Scooper” to “Waste Disposal”, incorporates information from the section “Boarding Fees/Veterinary Costs” into the section titled “Impoundment, and provides ticketing enforcement for lack of current license, running at large, and disturbing the peace. Title 24 V.S.A. § 1973 grants citizens the right to petition for a vote at a special or annual Town Meeting to disapprove the ordinance adopted by the Selectboard. To exercise this right, citizens must present to the Selectboard or the Town Clerk a petition for a vote on the question of disapproving the amendments signed by not less than five percent (5%) of the Town’s qualified voters. The petition must be presented within forty-four (44) days following the date of the adoption of the amendments. Unless a petition requesting a vote is filed pursuant to 24 V.S.A. § 1973, the adopted “Town of North Hero Animal Control Ordinance” shall become effective sixty (60) days from the date of said adoption. New Cingular Wireless PCS, LLC d/b/a AT&T is proposing to construct a 180’ communications tower and associated compound at the headquarters of the Grand Isle Sheriff’s Department, 10 Island Circle, Grand Isle, VT, and has distributed a 60-day advance notice in accordance with 30 V.S.A. 248a dated December 30, 2019. To assess the visual effects of the Project, AT&T has scheduled a balloon test at the site of the proposed Site on Thursday, January 9, 2020 from 9:00am–1:00pm, with a backup date of Friday, January 10, 2020 at the same times. The balloon will be flown to a height of 180 feet and will be photographed from public areas, which will then be used to generate photographic simulations of the Facility from various vantage points within one-and-a-half to two miles of the Site. These photographic simulations will be available for viewing on the webpage shown below and will be presented for the Selectboard’s consideration at a public hearing anticipated to be held on or about Monday, January 20, 2020. Being a parcel of land containing .92 acres, with a modular home and all improvements thereon, situated on the southerly side of Horican Avenue, so-called, in the Town and Village of Alburgh. In further aid of this description, reference is made to a plan of lands identified as “The Expanded Cleland Lot,” which said plan is dated May 11, 1993, by John H. Thetford and is recorded in the Alburgh Land Records. However, no warranty is made as to the said plan of lands. The property is subject to and benefitted by all easements and rights of way of record.
